Commentary by Attorney Michael Grossman

When I see reports of a crash like this, my first thought is that the injured passenger and his loved ones deserve clear answers about what happened. A collision where the driver is listed as “unknown” raises serious questions, and in my experience, cases like this often have underlying factors that aren’t immediately obvious. Before any conclusions can be reached, three key areas need further investigation.

First, did authorities conduct a thorough investigation? When a vehicle crashes and no driver is identified, it’s important to determine why. Did investigators check for signs that the driver may have fled the scene? Were there witnesses or nearby surveillance cameras that captured who was behind the wheel? Additionally, given that this crash happened at 2:30 a.m., did law enforcement consider factors such as poor visibility, road conditions or another vehicle’s involvement? A proper accident reconstruction should clarify how the crash happened and who was responsible.

Second, has anyone looked into whether a vehicle defect contributed to the crash? The Nissan Altima involved in this accident is a relatively modern vehicle, but mechanical failures can still occur. Did the steering, brakes or tires malfunction, making it difficult for the driver to maintain control? Some vehicles have been known to experience issues with stability control or unintended acceleration, which could be a factor in a crash involving a failed passing attempt. A forensic inspection of the vehicle is necessary to rule out any mechanical or electronic failures.

Finally, has all available electronic data been collected? Many modern vehicles, including the Nissan Altima, have an engine control module (ECM) that records key information such as speed, braking and steering inputs leading up to the crash. Retrieving this data could help determine whether the vehicle failed to respond as expected or if the driver took evasive action. Additionally, investigators should look for any nearby traffic or surveillance cameras that may have captured footage of the crash or the moments leading up to it. Phone records should also be reviewed to determine whether distraction played a role.

At the end of the day, a man suffered serious injuries in this crash, and he deserves to know what happened. A full and thorough investigation is the only way to ensure that no key details are overlooked. If any of these three questions remain unanswered, we simply don’t have the full story.
