Commentary by Attorney Michael Grossman

Something I see a lot after single-vehicle accidents is people immediately ready to blame the driver. That’s a dangerous presumption, though; what if something out of the driver’s hands sent the car off the road? What about poor road conditions like wet surfaces, potholes, or debris? What’s nighttime visibility like in that area? Is there signage to warn of the curve? Was the road wet? Any debris on it? Was the van in good repair? Could something have malfunctioned? Brakes, tires, steering? Did the safety equipment work properly during the crash? All these issues and more need to be considered and investigated.

Am I saying things have to be more complicated here? Of course not. The simplest explanation is most often the right one. However, that’s not an excuse to neglect other possibilities. The injured victim deserves the benefit of the doubt, and he deserves to know someone will find the truth about what hurt him. Who will do that in Montgomery County?
