Commentary by Attorney Michael Grossman

Investigating officers mentioned that alcohol might have been a factor in this crash. Part of me wonders if they hastily concluded that based on the time of night and the nature of the wreck, but whatever was behind their theory they didn’t collect any samples for testing. Why not?

That’s not to tell police their job; I’m just surprised they let that possibility go if it might explain how a man got seriously hurt. It’s also reflective of something I often have to tell people who call the firm about their injuries: Police reports, particularly the early ones written after a simple once-over at the scene, are not the gospel truth of most crashes. Extenuating circumstances and factors not contained within the crash scene contribute to these wrecks all the time, and it’s a pity how often they’re overlooked.

I don’t want to come down on police or question their hard work here. Sometimes they just don’t have the time or resources to do everything they would ordinarily do. Heck, they might even have collected samples for testing and then forgotten to record it. I’m only trying to point out that accident victims deserve to know their cases were handled carefully and investigated thoroughly. If there are further steps to take or people hold responsible, knowing that depends on what the investigations reveal.
