Commentary by Attorney Michael Grossman

When authorities mention alcohol as a possible factor in a crash, it raises important questions about how the situation unfolded. One of the most overlooked aspects of these cases is whether an alcohol provider contributed to the incident by over-serving a driver before they got behind the wheel.

Texas dram shop laws are designed to help prevent drunk driving crashes by holding bars, restaurants, and other alcohol providers accountable if they serve alcohol to someone who is obviously intoxicated. If investigators determine that alcohol played a role in someone getting themselves or others hurt, it’s worth asking where the driver had been drinking and whether the establishment followed the law.

At the end of the day, it’s important to get as much information as possible, and that’s only more important when it comes to holding someone accountable for their actions. If authorities only ever investigated as far as the crash scene here, then there could still be more to the story.
