Commentary by Attorney Michael Grossman

A crash involving a school bus always raises serious concerns, but the key question here is whether investigators will dig deep enough to understand why it happened. At first glance, this may seem like an open-and-shut case: the sedan driver ran a red light, crashed into the bus, and will likely be cited. But my experience handling commercial vehicle cases tells me that even when one driver’s actions seem to be the obvious cause, there’s often more to the story.

For one, the bus company’s role shouldn’t be overlooked. School buses are designed to protect passengers in a crash, but their safety depends on proper maintenance and driver training. Did the bus driver have enough time and space to react? Were the bus’s brakes and other safety features in working order? And was the driver properly trained to handle emergency situations like this? These are all critical questions that should be examined.

Beyond that, the intersection itself deserves scrutiny. Some intersections are poorly designed or have visibility issues that make red-light running more common. Were there previous crashes at this location? Were traffic signals working properly? A poorly timed light or an obstructed view could have contributed to this crash.

Authorities may issue citations and move on, but for those affected, the real concern is whether this crash was truly unavoidable. A proper investigation should consider not just what happened, but why it happened and whether anything could have been done to prevent it. If those questions aren’t answered, there’s a real risk that the same kind of crash could happen again.
