Commentary by Attorney Michael Grossman

One of the reasons I started this blog was to pose questions people don’t generally think of after serious accidents. Here, for example, I would want to see an accident reconstructionist clarify exactly why the victim’s injuries were so serious. Why is that?

I don’t see any information right now claiming the victim was speeding or wasn’t wearing their seatbelt. Also, this roadway isn’t a highway or freeway, so the speed limit isn’t all that high. So if a crash occurred, one would generally see a modern, safe vehicle protect occupants from suffering particularly serious injuries. Obviously, weird things can happen, but the fact of the matter is this can be a sign a safety feature failed to work properly. Did a seatbelt fail to lock? Did the airbag not go off? Is the vehicle’s crumple zone poorly designed? Was there a seatback failure?

Common or not, defects happen, and they require close attention from experienced accident reconstructionists. Rarely do the authorities handle that sort of thing on their own—certainly not in preliminary investigations. So is there nothing unusual that led to the victim’s injuries here, or have investigations just not been thorough enough yet?
