Commentary by Attorney Michael Grossman
While the facts surrounding this accident aren’t clear, any fatal work accident in Texas is going to present significant challenges. The reason for that is that Texas has the most complex work fatality law of any other state in the country. That’s primarily due to the fact employers are not required to subscribe to workers’ comp, meaning there is not always a guaranteed path to getting a victim’s family much needed benefits following an accident.
What many tend to assume is an automatic process to getting people the help they need can quickly become a family in need opposite a company doing everything in its power not to help them. Having the right experience and legal tools to navigate this legal maze can overcome these hurdles, but assuming authorities and OSHA handle everything on their own is usually a way to make those hurdles insurmountable.
