Commentary by Attorney Michael Grossman

Obviously, leaving the scene of an accident is going to bring up serious potential consequences. That’s only more true if authorities find out alcohol contributed to this accident. But among all of these possible factors, are authorities investigating the establishment (or establishments) the alleged runaway driver was coming from? If it turns out alcohol was a factor, and the suspect had been drinking at a local alcohol provider, that alcohol provider may also be responsible for contributing to this fatal accident.

Simply put, Texas law says alcohol providers can be held accountable if they over-serve someone who is obviously intoxicated. This can include potential criminal investigations, fines, suspended liquor licenses, and even liability if the intoxicated leads to people getting hurt or killed. Not only does this help ensure there are consequences for a drunk driver, but it also ensures any complicit alcohol providers clean up their act so they don’t go on to continue over-serving people and putting lives at risk.

My concern is that this area of Texas law too often goes overlooked. I’ve had hundreds of alcohol-related accident cases. Rarely do authorities investigate beyond a drunk driver’s actions. That means complicit negligent alcohol providers often only face consequences because victims or families demanded more thorough investigations. Perhaps authorities here are already being thorough, but it’s not something I would ever take for granted.
