As challenging as the investigations into an accident like this can be, there’s often another challenging aspect that doesn’t get enough attention: the steps that come next for the victim’s loved ones. Simply put, Texas has the most complex work fatality law of any other state in the country. For one, there isn’t always a guaranteed path for a victim’s family to receive benefits. On top of that, there can be exceptions about the responsibility an employer bears depending on their own actions leading up to and during the accident. Ultimately, this creates a legal maze that can prove challenging without the right experience and legal strategy. While these potential hurdles are ones that can be overcome, it’s important for families to understand that these obstacles exist so they can be sure they have the tools and allies needed to confront them.
