Houston, TX — November 3, 2024, Barakatullah Babakarhil was injured as the result of a car accident that happened around 6:11 p.m. on Loop 610.

According to initial details about the accident, it happened along eastbound lanes of the freeway between the Hardy Toll Road and the Eastex Freeway.

Investigators said that 34-year-old Barakatullah Babakarhil was in a Hyundai Elantra going eastbound on Loop 610. While doing so, a collision occurred involving a Honda Accord. Following this collision, details allege that the driver of the Honda failed to stop and render aid.

Babakarhil reportedly sustained serious injuries due to the accident. Authorities say they believe the Honda driver was under the influence of alcohol at the time of the accident. Right now, additional details are unavailable.

If the allegations mentioned in these reports are true, it wouldn’t be unusual if alcohol was indeed a factor. It’s a common reason people flee an accident scene. That may concern some folks, though, as they may think a driver who leaves the scene can’t have their BAC tested. It can make things more challenging, but there are other pieces of evidence that can help prove someone was intoxicated.

For example, I’ve handled hundreds of alcohol-related accident cases against negligent bars and other providers who contributed to the accident by over-serving the drunk driver. One aspect of those cases is proving the person the establishment over-served was obviously intoxicated. We do this through all kinds of details, such as security footage, witness testimony, receipts, credit card statements, medical expert testimony, and even texts and social media posts. As helpful as BAC is, it’s just one piece of many that can help build a case against both negligent alcohol providers and drunk drivers.

Of course, authorities have a higher bar to clear in criminal cases than the relatively lower standard we overcome in the civil courts. But that just means authorities need to be even more thorough in getting clear evidence so they can ensure there will be accountability for the actions that led to the crash.
