Commentary by Attorney Michael Grossman
I see a lot of people make the mistake that alcohol makes a crash open-and-shut. It’s not always just a matter of charging a drunk driver, and that’s that. I’ve handled hundreds of accidents involving drunk drivers, and it’s incredibly common for these accidents to involved a negligent alcohol provider who also needs to face consequences.
Simply put, bars and other similar establishments in Texas break the law if they over-serve someone who is obviously intoxicated. When they do so, it exposes them to potential criminal investigations, fines, suspended licenses, or liability for the injuries resulting from the intoxication. That’s why investigations into a drunk driving crash need to extend beyond the crash scene itself. There could be an accomplice who needs to be held accountable, both for the sake of the victims and families and the community as a whole.
Were those steps taken here?
