Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope the victim’s family is able to receive clear, fact-based answers about what happened. A single-vehicle rollover, particularly one that results in a fatality, should never be dismissed as just another unfortunate accident. Crashes like this often involve factors that extend far beyond simple driver error. To truly understand what happened on Interstate 20, we need to ask three critical questions.

First, did the authorities thoroughly investigate the crash? When a vehicle veers off the road and overturns, it’s important to determine why the driver left the roadway in the first place. Was the road surface compromised due to weather, debris or poor maintenance? Were there visibility issues, sharp curves or insufficient signage that could have influenced the driver’s response? Investigators should evaluate the condition of the roadway, document physical evidence like tire marks or impact angles and determine whether the driver may have been avoiding another vehicle or obstacle.

Second, has anyone considered whether a vehicle defect might have contributed to the crash? The Dodge Durango involved should be carefully inspected for any mechanical or electronic failures. Could a steering issue, tire blowout, brake failure or suspension problem have caused the vehicle to drift or become unstable? In rollover crashes especially, vehicle design and condition can make a significant difference in both whether the vehicle rolls and how survivable that rollover is. If the Durango’s stability control or rollover mitigation systems failed, or weren’t present, those factors must be identified before the vehicle is disposed of or repaired.

Finally, has all the electronic data related to the crash been collected? Most modern vehicles, including the Dodge Durango, are equipped with an engine control module that records pre-crash data such as speed, throttle position, brake application and steering input. This information can help reconstruct the final moments leading up to the crash and may reveal whether the driver attempted to correct course or was responding to a sudden issue. If the driver’s phone or GPS-enabled device was active, that data may also provide valuable context. As always, this type of evidence is highly time-sensitive and should be preserved as early as possible.

Crashes like this deserve a full, thoughtful investigation. A man lost his life, and without asking the right questions and collecting the right evidence, it’s all too easy to overlook contributing factors that might otherwise go undetected. Only by examining all aspects of the vehicle, the environment and the driver’s actions can we provide the family with the clarity and accountability they deserve.
