Commentary by Attorney Michael Grossman

Authorities didn’t seem to confirm any cause for the crash, saying rather that it’s possible the victim fell asleep at the wheel. Did they not ever get the victim’s side of the story? It may seem like authorities wouldn’t just abandon an investigation into a serious crash, but it’s unfortunately more common than folks realize.

The harsh reality is authorities tend to put single-vehicle wrecks low on their list of priorities. That leaves officers in the tough spot of having to move on to other responsibilities before they can really dig into the details. As such, investigations can be left incomplete or end up blaming the crash on what an officer feels is the most likely explanation. But if they only ever consider common factors like fatigue, speeding, drunk driving, or cell phone usage, they will inevitably end up wrongly blaming someone for a crash they had no way of avoiding.

Mechanical issues, road flaws, faulty brakes, medical emergencies, and even potential hit-and-runs are important to consider, as well. At the very least, they can be definitively ruled out. Anything short of that simply isn’t good enough.
