Commentary by Attorney Michael Grossman

If authorities are correct that alcohol played a role in this crash, the investigation shouldn’t stop at the driver. A key question that often goes overlooked is where the driver was drinking before the crash and whether an alcohol provider contributed to their level of impairment.

Texas dram shop laws make it unlawful for establishments to serve alcohol to someone who is obviously intoxicated. If an alcohol provider ignored this legal responsibility and continued serving the driver before the crash, they may share responsibility for what happened here.

Too often, though, authorities overlook this possibility. In my experience handling hundreds of alcohol-related accidents, victims and families don’t just want someone to blame. They want to see accountability. That means conducting thorough investigations and ensuring all responsible parties face appropriate consequences.
