Commentary by Attorney Michael Grossman

I talk a lot about alleged drunk driving accidents on this blog to help spread the word that investigators also need to find out if a negligent alcohol provider unlawfully over-served the drunk drivers. Those establishments may also need to be held accountable for their role in a serious accident. But at just after 6:00 a.m., hours after bars have closed, is that even possible? Of course, and let me explain why.

Having handled hundreds of alcohol related accident cases, I’ve had cases where a drunk driver was two, three, even four or more times over the legal limit for drunk driving. Let’s say someone drinks at a bar all the way up to last call (2:00 a.m.), then leaves at three times the legal limit. Generally speaking, after four hours of not touching another sip of alcohol, that person would still be over twice the legal limit for drunk driving. So even when a crash happens hours after someone is able to legally buy alcohol, it’s still important to make sure there aren’t any accomplices to the crash being let off the hook. I don’t see any reason right now why this crash would be an exception.
