Commentary by Attorney Michael Grossman

If the current information on this crash is true, then it wouldn’t be any surprise to see an alleged drunk driver held accountable for their actions. What would be unusual to see, though, is if authorities have looked into where this alleged alcohol came from. Folks don’t often know this, but alcohol providers can be responsible for contributing to serious accidents, as well.

Simply put, bars and other establishments in Texas who unlawfully over-serve obviously intoxicated customers can potentially face criminal investigations, fines, suspended licenses, and liability for harm resulting from that intoxication. Doing so not only ensures there is an opportunity to hold all wrongdoers accountable after a serious accident, it also can help put negligent alcohol providers on the straight-and-narrow before their actions cause more harm.

Unfortunately, I’ve handled hundreds of cases against negligent alcohol providers, and I rarely see authorities act on their own to investigate these possible accomplices. It’s possible authorities here are working behind the scenes to ensure those affected by the crash see all responsible parties held accountable. In my experience, though, that usually requires more thorough independent investigations.
