Commentary by Attorney Michael Grossman
Crashes like this often raise questions about how multiple factors contributed to such a serious outcome. In this case, authorities allege that the driver of the Ford Edge was intoxicated at the time of the collision. If true, this brings to light the critical need for a deeper investigation into where and how the driver consumed alcohol before getting behind the wheel.
Under Texas law, alcohol providers have a legal obligation not to serve patrons who are obviously intoxicated. If the driver of the Ford Edge had been drinking at a bar, restaurant, or other establishment, investigators must determine whether that business overserved her. If so, the establishment could share responsibility for the injuries caused under Texas dram shop law.
Dram shop accountability is about more than assigning fault—it’s about ensuring that alcohol providers serve responsibly and follow the law to prevent crashes like this. These laws empower those harmed by alcohol-related crashes to seek justice while reinforcing the message that reckless alcohol service has real consequences.
For the injured parties, getting the full truth about what led to this collision is essential. Investigating whether an alcohol provider contributed to this crash can help ensure accountability and provide an additional layer of deterrence against similar incidents in the future. By addressing all contributing factors, we take meaningful steps toward making Texas roads safer for everyone.
