Randall County, TX — November 10, 2024, 49-year-old Albert Herrera Jr. was killed in a single-vehicle accident on U.S. Highway 87 in Randall County.
According to authorities, the incident happened around 1:10 a.m. on U.S. 87 south of Canyon. Preliminary investigation suggests Albert Herrera Jr. was driving a Ford F-250 pickup on the highway when the vehicle lost control for unknown reasons. It then veered into the median and then reportedly went a side-skid before rolling over.

Herrera sustained fatal injuries as a result of the accident.

If news reports have their facts straight, investigators think the victim of this accident might have been under the influence of alcohol. I have no specific reason to argue with them, though aside from the general circumstances of the accident it’s not clear how they decided that. Still, if that’s their theory I hope they will conduct the relevant testing in search of proof. Some may consider it more or less irrelevant since there is no possibility of charges, but confirming (or disproving) that alcohol was a factor could have farther-reaching implications. Depending on what’s learned, another party may be responsible for the terrible damage done in the crash.
Statistically speaking, most impaired driving happens after people leave businesses that specialize in getting people drunk. If evidence shows that a business over-served their customer long past his limits, then sent him on his way too intoxicated to drive, then that business broke Texas dram shop law. It may then have a duty to help the victim’s relatives through the pain and difficulties of their loss.
To be clear, even if investigators believe alcohol played a part that’s not the same as proving it. I don’t know more than reports can say and I’m not claiming that drinking was a factor, let alone that a Randall County business provided too much of it. Will police even look into that possibility, though? Not only do the victim’s loved ones deserve the whole story, but if a business is willfully endangering its community through over-service then that behavior must be stopped.
