Commentary by Attorney Michael Grossman

Crashes like this one, where a pickup truck rear-ends a stopped 18-wheeler, often lead to assumptions about fault resting solely with the trailing vehicle’s driver. While it’s true that drivers have a duty to maintain safe following distances and remain attentive, in my experience, such crashes often warrant a deeper investigation into all contributing factors.

One key issue is whether the 18-wheeler was visible and properly positioned as it waited to turn. Federal regulations require commercial vehicles to use brake lights and signals to alert other drivers to their intentions. Investigators should determine whether the truck’s lights were functioning correctly and clearly visible to approaching traffic. If the truck lacked adequate signaling, or if it was positioned in a way that reduced its visibility, that could indicate a shared responsibility for the crash.

Another critical consideration is whether the pickup driver was aware of the stopped truck in time to react. Factors such as sun glare, road conditions, or obstructed views could have delayed the driver’s recognition of the hazard. Similarly, it’s important to examine whether distraction or impairment may have played a role, as these are common contributors to rear-end collisions. Investigating these concerns is central to coming to a full understanding of who might share responsibility in cases like this.

Lastly, it’s worth reviewing whether the trucking company maintained the vehicle properly and ensured the driver was following safety protocols. A lack of proper maintenance or insufficient driver training could contribute to situations where a collision becomes more likely. These factors should be thoroughly investigated to establish whether any additional parties bear responsibility for what occurred.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
