Commentary by Attorney Michael Grossman
With motorcycle accidents, there’s always a concern about how thorough investigations have been. A lot of people are unfairly biased against motorcyclists, and this can even lead to authorities jumping to conclusions. That’s why it can be very crucial to follow up with them and ask some key questions.
Did investigators take the time and use the right tools to fully analyze the crash? A motorcycle losing control could be influenced by road hazards, evasive maneuvers, or other external factors. If authorities made assumptions rather than conducting a full reconstruction, important details may have been overlooked.
Did they check for potential mechanical failures? Issues like brake malfunctions, steering problems, or tire defects can be especially dangerous for motorcyclists. Additionally, if a helmet or other protective gear failed, injuries may have been worse than necessary. Were these factors properly investigated?
Did they secure all available electronic evidence? Motorcycles may not have the same onboard data storage as cars, but GPS records, cellphone activity, and nearby traffic or security cameras could provide valuable insights. Did authorities take steps to preserve this evidence before it was lost?
If authorities have investigated these questions, they’re likely prioritizing the evidence, which is a vital step in making sure a rider’s side of the story is at least told fairly. But if they can’t show that they’ve considered these possible factors, it may be a sign they’re letting their bias take over. That’s when it may be more prudent to have independent investigators look into the circumstances more thoroughly.
