Commentary by Attorney Michael Grossman

When people hear about an accident involving a motorcycle and an 18-wheeler, they often assume it’s a straightforward case of driver error. However, in my experience, incidents like these are rarely that simple. They require thorough investigation to understand all contributing factors and ensure accountability.

First, we need to determine what led to the collision. Was the truck driver distracted, fatigued, or perhaps misjudged the speed of the oncoming motorcycle? Collecting data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements can provide crucial insights into these questions.

Next, the trucking company’s role must be scrutinized. Was the truck driver adequately trained and following safety protocols? Trucking companies have a responsibility to ensure their drivers are well-prepared for the demands of the road. If the company neglected proper training or allowed unsafe driving practices, they might share responsibility for the crash.

Additionally, we must consider the condition of the truck. Was it properly maintained? Mechanical failures, such as brake malfunctions or steering issues, can significantly contribute to accidents. Reviewing maintenance records and conducting thorough inspections of the vehicle can reveal if such problems played a role.

Investigations should go beyond the crash scene to uncover the full story. This includes looking into the truck driver’s logs, evaluating their driving history, and consulting with accident reconstruction experts. Only with a comprehensive approach can we ensure that all responsible parties are held accountable.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Whether through obtaining vital evidence or, if necessary, conducting an independent investigation, it’s crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
