Commentary by Attorney Michael Grossman

One of the oldest misconceptions people ask me about is rear-end collisions automatically being the fault of the rear driver. That’s simply not true. In fact, it would be ludicrous if it were.

Let me give an example. There was a crash some time ago where a father and his kid died after their vehicle hit the back of an 18-wheeler on a dark highway. That’s all anyone knew for some time, but eventually investigations revealed that the 18-wheeler had just pulled off the shoulder without turning its lights on. Would any reasonable legal system blame the victim for that crash simply because they were unlucky enough to rear-end someone? Of course not.

Now, I’m not saying anything like that happened here. What I am saying, though, is the evidence needs to be able to speak for itself. Regardless of what is the most likely explanation, getting answers means ensuring no stone goes unturned. It remains to be seen if authorities made sure of that or if this situation would fare better in the hands of independent investigators.
