Commentary by Attorney Michael Grossman

When crashes like this happen—where a vehicle drifts across the centerline and causes a deadly head-on collision—people often stop at the assumption that the driver simply lost focus. But in my experience, especially when lives are lost and multiple people are injured, there’s usually more that needs to be understood. To fully uncover what led to this devastating wreck on U.S. Highway 84, there are three critical questions that should guide any thorough investigation.

First, did authorities conduct a detailed review of the roadway conditions and layout at the location of the crash? Lane departure crashes can be influenced by faded centerline markings, uneven pavement, road curvature, or sudden visual obstructions. On a two-lane highway, even a slight deviation from the lane can quickly become catastrophic. Investigators should closely evaluate whether the road’s design or condition may have contributed to the Nissan Maxima’s lane departure.

Second, has anyone looked into whether a mechanical failure in the Nissan played a role? A sudden problem with the vehicle’s steering, suspension, or tires could have caused it to veer off course. Likewise, if the car’s stability or lane-keeping systems malfunctioned—or were not present—this could have significantly limited the driver’s ability to recover. These types of questions can only be answered through a forensic examination of the vehicle in its post-crash condition.

Finally, has all electronic and digital evidence been gathered? Modern vehicles typically include event data recorders that store information like speed, throttle position, braking, and steering input in the moments leading up to a crash. That data can be essential in determining whether the driver attempted to correct course and whether the vehicle responded properly. Investigators should also pursue dashcam footage, nearby surveillance video, and GPS or cell phone data that might clarify the timeline and conditions leading to the crash.

Answering these three questions is critical to making sure that no stone is left unturned in understanding the causes of a crash like this. Serious wrecks deserve serious investigation, not assumptions. Getting clear answers to these questions is crucial for those seeking to understand what happened and why—and it’s the least that can be done to help those affected find the clarity and closure they deserve.
