Commentary by Attorney Michael Grossman

When accidents like this occur, people often focus on the immediate collision, assuming it stems from a simple error or miscalculation. However, in my experience, crashes involving commercial trucks often have deeper and more complex contributing factors that require thorough investigation to uncover.

One important question is what led to the truck driver’s alleged faulty evasive actions. Did the driver encounter an unexpected hazard, or were they reacting to something they failed to anticipate or notice earlier? It’s crucial to determine whether the driver was fully attentive and exercising proper caution. Distractions, fatigue, or misjudgment in such situations can turn an ordinary moment into a catastrophic event. Investigators must examine whether any of these factors played a role in the truck driver’s actions.

Another area worth scrutiny is the trucking company. These companies are responsible for ensuring their drivers are adequately trained and able to handle emergency situations safely. Were policies or delivery schedules putting undue pressure on the driver to take risks? Did the driver have a history of safety issues or insufficient training? By understanding the company’s role, investigators can assess whether corporate negligence contributed to the crash.

Additionally, it’s critical to consider the condition of the semi-truck itself. Trucks must be maintained to high safety standards, including functioning brakes, steering mechanisms, and properly balanced loads. Were all systems in working order, or did a mechanical issue force the driver into those evasive actions? Furthermore, all lights, reflectors, and signals must be functional and visible to ensure that other motorists, like those in the Tacoma, can respond appropriately to a truck’s movements.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
