Commentary by Attorney Michael Grossman

With these kinds of accidents, I always have concerns about how they’re being handled. Frankly, single-vehicle wrecks aren’t often seen as a high priority, so authorities sometimes jump to conclusions or move on without knowing all of the facts. That’s when important details slip through the cracks.

For example, I handled a case not long ago where authorities missed a major vehicle defect. They blamed a victim for not wearing their seatbelt, which is something the family felt was very unlike the victim. They wanted a second opinion, and more thorough independent accident investigations revealed the driver’s seatbelt was defective. The victim was wearing the belt properly, but the defect led to them being thrown from their seat, and authorities just falsely assumed that meant the victim wasn’t properly secured. Thanks to the independent investigations, the family learned the truth, and authorities corrected their reports.

I’m not saying that happened here or even that such incidents are common. The fact of the matter is authorities can’t really say what happened if they don’t have the tools or time to really dig into all of the possibilities. Maybe authorities here have been able to do so, and those involved feel confident they’re getting the whole story. Otherwise, if there are still unanswered questions about what happened here, it’s very possible getting the facts will require more thorough independent investigations.
