Houston, TX — June 16, 2024, Juan Fortanelli was injured following a car accident at around 2:30 a.m. along Monroe Road.

Authorities said in their statements that the crash happened in the area of the Monroe Road and Wayfarer Lane intersection.

It appears that 57-year-olkd Juan Fortanelli was in a Ford F-150 going southbound along Monroe alongside a Chevy Camaro. Authorities say there were conflicting statements about what ensued, but it resulted in Fortanelli’s vehicle and the Camaro colliding. As a result, Fortanelli’s vehicle ran off-road and hit a pole. Fortanelli was seriously injured due to the crash.

With conflicting statements, how is fault supposed to be determined? Unfortunately, this is a frustrating fact of the law that a lot of people end up wrestling with. At the end of the day, it’s about who has the most convincing evidence. Authorities are not necessarily interested in getting that evidence. Their priority is to file charges or citations. Short of that, they often just leave people to figure things out on their own.

For example, I handled a case where two people crashed at a traffic light, and each driver blamed the other for running the light. No witnesses came forward, so the investigating officer just threw up his hands and said, “Y’all figure it out.” Well, one of them contacted us, and it was barely a week before we found security video from a nearby business that showed clear as day that the other guy ran the light.

I wish that was an unusual situation, but it would surprise folks to see how often authorities let something important slip through the cracks. That’s why I warn people that there’s really no such thing as a simple or straight-forward car accident. Victims and families involved have to be sure they can not only tell their side of the story but also prove it. Right now, I don’t see why this crash would be any different.
