Commentary by Attorney Michael Grossman

It is clear that authorities are just beginning to investigate this crash, but my experience with such cases over the past 30 years points to several possible factors worth investigating:

What Caused the Crash? The details provided do not specify how the collision occurred, or which vehicle might have initiated the incident. Investigators need to determine the sequence of events leading to the crash. Was one vehicle improperly merging, stopping, or maneuvering? Did the load on the semi-truck shift, potentially destabilizing the vehicle?

The Role of the Semi-Truck’s Load: Concrete blocks are an extremely heavy and potentially unstable load if not properly secured. Federal regulations require such loads to be firmly anchored and periodically inspected. Investigators should assess:

  • Whether the load was secured correctly.
  • If improper load distribution contributed to the semi-truck’s handling issues.
  • If the cargo shifted during the collision, worsening the impact.

Driver Behavior and Condition: Both drivers’ actions leading up to the crash need review. Were either of them distracted, fatigued, or driving aggressively? Cell phone records, in-cab cameras, and witness statements could provide insight. Were the drivers operating at safe speeds given the highway conditions and the time of day?

Road and Traffic Conditions: State Route 53 during early morning hours might have low visibility, increased traffic, or weather-related hazards. Investigators should evaluate whether environmental factors contributed, such as slick roads, fog or inadequate lighting.

Vehicle Maintenance and Mechanical Failures: Investigators should examine both vehicles for potential issues, such as brake failure, steering malfunctions or worn tires. Particularly for the semi-truck, proper maintenance of heavy-duty vehicles is critical to handling the demands of their cargo.

Emergency Response and Extrication: The need to extricate two individuals from the box truck suggests significant vehicle damage. This raises questions about the crash’s force and whether the box truck had adequate safety features like crash-resistant frames or seatbelt use.

This crash highlights the potential dangers posed by heavy loads like concrete blocks and the importance of compliance with cargo securement regulations. While box trucks are smaller and more agile than semi-trucks, their drivers are still expected to follow commercial driving best practices. Both vehicles’ roles in the collision need careful scrutiny to ensure that fault is assigned based on evidence.

I hope the ongoing investigation will reveal the chain of events that led to this accident, but authorities don’t always have the time, training or other resources to handle complex commercial vehicle crashes like this one. An independent probe may be needed if authorities cannot answer the questions I have posed here.
