Mateo Gonzalez Moreno, Jacqueline Moreno Car Accident in Weatherford, TX

Investigators said that 37-year-old Mateo Gonzalez Moreno, 33-year-old Jacqueline Moreno, a 71-year-old woman, and three children were in a Chevy Suburban going westbound along I-20. From the oncoming lanes, a GMC Terrain was reportedly passing vehicles on the left shoulder when it lost control and crossed the median. There, the GMC crashed into the Morenos’ Chevy.

Due to this, Mateo Gonzalez Moreno, one of the children in the Chevy, and the GMC driver had serious injuries. Jacqueline Moreno and the other three occupants of the Chevy had reportedly less severe injuries. Right now, details suggest that authorities recommended the driver of the GMC face charges for intoxication assault. No further information was released.

Commentary by Attorney Michael Grossman

If the allegations are true, intoxication would certainly explain a vehicle suddenly losing control like this. The question, though, is if the intoxicant was drug-related or alcohol-related. Believe it or not, this makes a big difference, but it’s unfortunately not a distinction authorities tend to care much about.

Let me given an example to show why I say that. I had a case not long ago where a driver went into oncoming traffic, hit a car head-on, and nearly got a kid killed. The authorities found the driver to be intoxicated, they filed their charges, and that was that. After the family contacted us, just to make sure they weren’t missing anything, we started digging into where that driver was coming from. It turned out he was at a bar that illegally over-served him, and that opened them up to potential criminal investigations, fines, and license suspensions, and ultimately they were liable for the injuries they caused.

Simply put, authorities were so narrow in their investigations that they nearly let the bar off the hook for its role in a child almost losing their life. Had that family not thought to look for a second opinion, there’s no telling if the full story ever would have come to light. Situations like that are unfortunately common despite how seriously our communities take intoxicated driving. I’ve had hundreds of cases against negligent alcohol providers for their role in serious accidents, and it’s not at all unusual for authorities to let such possibilities slip through the cracks. So as open-and-shut as folks may think these details are, there could still be a lot more to the story which has yet to be brought to light.
