Commentary by Attorney Michael Grossman

When someone drifts across a quiet rural highway in the middle of the night and never makes it home, the cause isn’t always clear. But what is clear is that crashes like this often go underexamined simply because there’s no other vehicle to point the finger at. That doesn’t mean there’s nothing to investigate.

1. Did the authorities thoroughly investigate the crash?
Single-car crashes often get short shrift, particularly when they happen at off-hours. But veering across an empty road and crashing into a fence raises serious questions. Did officers check for tire marks indicating loss of control? Was the vehicle’s path reconstructed to determine if this was a slow drift or a sudden swerve? And was any effort made to establish whether the driver may have been fatigued, distracted, or reacting to something in the road? These are basic steps that are too often skipped.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?
There’s no indication yet that mechanical failure was ruled out. A problem with the steering system, suspension, or even a tire blowout could send a vehicle veering across lanes with little warning. Additionally, modern vehicles like the Kia Sorento often include safety systems that are supposed to correct or warn against lane drift—so if those failed or weren’t working, that matters too. Only a proper mechanical inspection can surface these issues.

3. Has all the electronic data relating to the crash been collected?
The Sorento likely captured detailed data in the seconds before the wreck: vehicle speed, steering angle, braking force, and any activation of stability control systems. That data could tell investigators whether this was a deliberate action, a delayed reaction, or a sudden failure. In a crash with no eyewitnesses, that kind of information is often the only way to understand what truly happened.

Even when no one else was involved, a fatal crash deserves serious questions. Otherwise, the story told is only half-finished—and key answers remain buried with the wreckage.

Takeaways:

  • Drift-off-road crashes should be reconstructed to determine whether the vehicle reacted or simply veered.
  • Mechanical issues like steering failure or lane assist malfunctions need to be ruled out.
  • Black box data from the vehicle may be the only way to understand the driver’s final moments.
