New York, NY — October 16, 2024, Edwin Seixas was killed due to a truck accident at around 10:20 p.m. along Interstate 95.

Initial details about the crash from the NYPD say it happened along southbound lanes of I-95 in The Bronx near Baychester Avenue.

Right now, few details leading up to the crash are available. Officials said that 40-year-old Edwin Seixas was in a vehicle going along the thruway. Up ahead, a tractor-trailer was reportedly stopped and unoccupied in a lane of travel. Seixas’s vehicle crashed into the stationary truck, resulting in fatal injuries. There did not appear to be any other injuries resulting from the accident. Investigations are ongoing.

It always raises red flags to me whenever a commercial vehicle stops in a lane of travel on a major roadway. Is it possible this was some unusual, unavoidable circumstances the truck driver had no control over? Certainly, but it’s important to have as much evidence telling the story as possible. A lot of the time, truck drivers can avoid creating obstructions like this, or they can at least make the obstruction as visible as possible to help avoid an accident. That’s why a crash like this brings up the possibility of a driver creating an unnecessary and deadly hazard.

For example, I handled a case a while back where a truck driver reportedly stopped on a highway due to an “unforeseeable” mechanical issue. Once we started pulling maintenance records and reconstructing the accident, though, it turned out the accident was completely avoidable. For one, the mechanical issue happened because the company had neglected routine maintenance work for months. Simple repairs likely could have prevented the entire incident. Secondly, the truck driver was stopped for several minutes, but he made no effort to put out cones or flares to ensure the obstruction was visible. And lastly, the driver didn’t actually have to stop in the roadway. He could have continued driving until he safely pulled over out of the way of traffic. Instead, he panicked and put everyone around him in harm’s way.

Like I said, there are times where a truck stopping in the middle of the road is unavoidable, and truck drivers can take appropriate steps to ensure the obstruction is visible and avoidable. Other times, though, a truck driver’s lapse in reason, inexperience, or history of making mistakes can culminate in someone senselessly losing their life. Is that what happened here? And if so, are authorities taking the proper steps to preserve evidence and see there are appropriate consequences for those responsible?
