Commentary by Attorney Michael Grossman

Both single-vehicle accidents and crashes involving young drivers can cause a lot of confusion. Many people, even authorities, may be quick to jump to conclusions without considering the victims’ sides of the story. That’s why it can be helpful to consider a few key factors.

1. Were Authorities Equipped for a Comprehensive Investigation?

Authorities often face time constraints and may not have the specialized tools or training to identify deeper issues like subtle road defects, hazardous conditions, or poor signage. Without the ability to conduct a thorough investigation, critical evidence can be overlooked, leaving important questions unanswered.

2. Could a Vehicle Defect Be Involved?

Mechanical failures like brake malfunctions, tire blowouts, or steering issues could play a significant role in a crash. Identifying these problems takes years of expertise and specialized equipment. Advanced safety features in modern cars, such as lane-keeping assistance, can also fail unexpectedly, requiring a detailed inspection to determine if a defect was at fault.

3. Was All Electronic Data Examined?

A vehicle’s Electronic Control Module (ECM) provides crucial data about speed, braking, and steering inputs. Additionally, cellphone records can reveal whether the driver was distracted in the moments before the crash. Failing to collect and analyze this data can leave key details unexamined.

Ultimately, if authorities can provide satisfactory answers, it’s usually because they’re being fair and unbiased in their efforts to investigate the crash. But if their answers seem lacking or don’t add up, it can be a sign that the investigations may need a second set of eyes.
