Accidents like this are unfortunately predictable every summer, but that doesn’t mean they should be seen as unavoidable. An apartment complex drowning, for example, can be particularly intricate, as investigations would have to consider the condition of the property itself. Property owners owe a basic duty to ensure children can’t access a pool unattended. Were those precautions taken on this property? Were there any issues, such as a gate that wouldn’t latch or easily climbable features near fencing? Investigations may very well rule out any such extenuating circumstances, but that alone is an important step after any fatal accident, let alone one that takes the life of a child.
