Commentary by Attorney Michael Grossman
If the allegations here are true, then a driver possibly being charged for intoxication assault is quite serious. But that may not be the end of the story. Have authorities also looked into where the alleged alcohol came from?
Under Texas law, alcohol providers, such as bars, restaurants, or other venues, have a legal responsibility to avoid serving alcohol to someone who is obviously intoxicated. If the driver of the Dodge was over-served before this crash, the establishment that provided the alcohol may share responsibility for the for the resulting accident.
Too often, this goes overlooked by the authorities. Out of hundreds of cases I’ve handled against negligent alcohol providers, few were on the authorities’ radar until after the victims and families sought out our help. There were even times we handed evidence over to the authorities, and they still didn’t make an effort to pursue their own investigations. Authorities here may have been more thorough, but there’s nothing in these initial reports to suggest that yet.
