Commentary by Attorney Michael Grossman
Simply having someone being blamed by authorities might have people thinking this all is open-and-shut. However, it’s important to know not just what happened but also why it happened. Accidents like this are sometimes a lot more complex than they appear.
Was the driver intoxicated? Were they on their phone? Was this a work truck the driver wasn’t qualified to operate? Were they being pressured to meet unreasonable deadlines or work long hours? Did a lack of maintenance cause the truck not to slow down in time? Was the trailer overloaded or in a state of disrepair?
These questions can lead to all sorts of complex legal issues that a typical police investigation won’t likely be able to address on its own. As such, crashes like this often fare better when in the hands of more thorough independent investigators.
