How Did This Accident Occur?
A lot of people see rear-end collisions like this and assume the victim must automatically be in the wrong. That’s simply not true. It’s a misconception that drivers are automatically responsible when they rear-end someone.
For example, what if the driver is cut off by a reckless driver? What if their brakes fail because of a vehicle defect? What if they’re swerving to avoid some other reckless driver who leaves the scene? The full context of a crash matters, and it would be ridiculous to have some one-size-fits-all legal conclusion for crashes that can involve countless contributing factors.
Is it possible this crash involved something common, such as cellphone usage? Of course, but it’s important that there are thorough investigations that consider all possibilities before folks start jumping to conclusions. Hopefully that happens here so the victim’s loved ones can get the full story.
