How Did This Accident Occur?
I can’t say exactly what happened in this accident, but pedestrian accidents often come down to either pedestrians crossing the road when or where they shouldn’t or drivers not paying attention the road ahead of them. A lot of folks think it’s all about who had the right-of-way. That’s important, but it’s far from the only factor worth considering.
For example, let’s say a pedestrian is in the middle of the road where there’s no crosswalk. If they’re not clearly visible or avoidable, it would obviously be ridiculous for a driver to be responsible for hitting someone they couldn’t reasonably avoid. But, let’s say the pedestrian was well-lit, clearly visible, and far away enough that a driver paying attention and going at appropriate speeds could slow down and avoid the collision. Would a driver get a free pass to run someone over just because they have the right-of-way? Of course not, that would also be ridiculous.
That’s why it’s important not to write off accidents like this as simple or open-and-shut. They can involve complex factors just like any serious car accident. Either authorities will conduct investigations accordingly and cover all possible factors, or independent investigators can step in to cover what authorities missed.
In the meantime, if anyone lives in this area, is it common to see pedestrians out and about at this time of night? Let me know in the comments.
