Commentary by Attorney Michael Grossman
If it’s true that alcohol was a factor here, people might think that makes things open-and-shut. It might actually make things more challenging. It’s not just about if someone was drinking but also where that alcohol came from. Here’s why.
In Texas, alcohol providers can be responsible for accidents involving someone they unlawfully over-served. If a bar or restaurant patron shows obvious signs of intoxication, alcohol providers serving them is breaking the law. As such, they can face consequences when it results in people getting hurt or killed.
Too often, this goes overlooked. Authorities might begin and end their efforts behind the wheel. So if alcohol was a factor here, it’s important to know if all parties responsible for the crash are actually answering for their actions.
