Commentary by Attorney Michael Grossman

People often think pedestrian accidents only come down to right-of-way. As important as that is, it’s important to know how reasonably avoidable the collision was. If a driver should be able to see and avoid someone in the road, they have a duty to avoid them. Otherwise, if the pedestrian simply isn’t avoidable, it would be ridiculous to hold a driver accountable for that. Authorities alleging this driver wasn’t properly licensed does raise questions about the driver’s experience. Hopefully that was carefully considered in their investigations.
