Commentary by Attorney Michael Grossman

When authorities allege that a driver was more than three times the legal limit, it raises serious concerns—not just about the driver’s actions, but about how they reached that level of intoxication in the first place. That’s where the role of an alcohol provider needs to be considered.

In Texas, it’s unlawful for an alcohol provider to serve someone who is obviously intoxicated. If the driver responsible for this crash was over-served at a restaurant, gas station, or similar establishment, that provider may share responsibility for what happened.

Unfortunately, investigations into alcohol-related crashes often stop with the driver. But many of the victims and families I’ve worked with over the years didn’t just want someone to blame—they wanted the full story. That meant ensuring all wrongdoers are held accountable for their role in the accident.
