Commentary by Attorney Michael Grossman

When a crash involves a rear-end collision that leads to a fatality, people often assume that the circumstances are straightforward. However, my experience investigating these types of accidents has shown that they are often more complex than they first appear. Before reaching any conclusions, it’s important to ensure that the investigation answers three key questions.

First, did the authorities thoroughly investigate the crash? Law enforcement will likely document the scene, assess vehicle positions, and gather witness statements. However, key questions remain: Were there any road hazards, sudden slowdowns, or external factors that contributed to the collision? Did investigators review traffic camera footage or collect statements from other drivers who may have witnessed the crash? A thorough reconstruction is critical to understanding how and why both vehicles left the roadway.

Second, has anyone looked into the possibility that a vehicle defect contributed to the crash? Rear-end collisions can sometimes be linked to brake failures, sudden acceleration issues, or even electronic malfunctions that prevent a driver from responding in time. Did either vehicle experience a mechanical issue that contributed to the collision? Were all safety systems—such as brake lights and crash-avoidance technology—functioning properly? These are questions that can only be answered through a detailed forensic examination of both vehicles, but if no one takes steps to preserve them, those answers may be lost.

Finally, has all the electronic data related to the crash been collected? Most modern vehicles are equipped with electronic control modules (ECMs) that store key data, including speed, braking activity, and steering input leading up to the crash. Additionally, surveillance footage from nearby traffic cameras or businesses may provide crucial context. Cell phone records could also help determine whether external distractions played a role. The challenge is that this evidence isn’t automatically preserved—ECM data can be overwritten, surveillance footage is often deleted within days, and vehicles may be quickly repaired or salvaged before a proper review is conducted. Ensuring that this information is secured promptly is critical.

At the end of the day, crashes like this leave families with difficult questions, and they deserve real answers. When a vehicle is struck from behind and forced off the road, the least we can do as a community is ensure that every possible factor is examined so that those affected aren’t left without the clarity they deserve.
