Commentary by Attorney Michael Grossman
When a single-vehicle motorcycle crash like this occurs, what are the most important questions to ask? In my experience, understanding the circumstances requires carefully addressing three critical questions: Did authorities conduct a thorough investigation? Has anyone looked into whether a mechanical failure or defect might have caused or contributed to the accident? And, has all the available electronic and physical evidence been secured to get a complete picture of what happened?
First, was the crash thoroughly investigated by authorities? A single-vehicle crash, especially one involving a motorcycle, is often attributed to operator error without much scrutiny. While this might occasionally be true, it’s critical to rule out other potential factors. Did the roadway present hazards like uneven pavement or debris? Were the conditions at the time—lighting, signage, or weather—contributing factors? Authorities must carefully document the scene and analyze whether external factors played a role. If they fail to do so, important details could be overlooked.
Second, could a mechanical failure or defect have contributed to the crash? Motorcycles are highly susceptible to issues like brake failure, tire blowouts, or even poorly maintained steering systems, any of which could cause a loss of control. Did investigators examine the motorcycle for signs of failure, or was it quickly removed without a deeper inspection? Without a detailed mechanical evaluation, critical evidence might be lost forever.
Finally, has all available evidence been collected? The motorcycle itself could provide physical clues, and electronic data—such as from onboard monitoring systems—might help clarify events leading to the crash. Additionally, witness statements and any available surveillance footage from the area are invaluable in reconstructing the sequence of events. Gathering this evidence as soon as possible is essential to ensure nothing vital is missed.
Single-vehicle crashes involving motorcycles require careful and comprehensive investigations to uncover the factors that led to the incident. By addressing these questions, investigators can provide a clearer understanding of what happened and why. For Manuel Salaiz and his loved ones, obtaining these answers is a critical step toward clarity and closure.
