Commentary by Attorney Michael Grossman

One of the biggest challenges with single-vehicle wrecks is making sure investigators are getting the whole story. It sometimes surprises people to learn how often I get calls from victims or families affected by a single-vehicle crash who feel like authorities are mishandling the investigations. People tend to think that fewer vehicles being involved makes for a more simple accident reconstruction. That’s not really true though.

The problem isn’t necessarily the complexity of the crash itself; it’s the motivation of investigators to spend time and effort on them. Authorities don’t often see single-vehicle wrecks as a high priority, so they may fail to consider less likely possibilities which could involve factors beyond the victim’s control. Mechanical issues, faulty safety devices, poor lighting, missing signage, improper road design, etc. Likely or not, these things happen. Instead, authorities often assume the driver is to blame, and they move on to other jobs before considering any evidence that might cause them to rethink their conclusions. There could even be information the victims weren’t aware of that only more thorough investigations could bring to light.

Clearly, there isn’t enough information here to draw any concrete conclusions, and it’s possible authorities have been thorough behind the scenes to make sure the victim had an opportunity to tell their side of the story. But if this turned out to be another situation where official investigations came up short, it wouldn’t at all be unusual.
