Commentary by Attorney Michael Grossman
With a single-vehicle bus crash like this, one key questions comes to mind: Was this accident foreseeable and avoidable? A lot of people just look at single-vehicle wrecks and assume the driver must have done something wrong. Frankly, that’s the most likely explanation. That would bring up concerns of what this driver was doing or whether or not they were qualified to safely transport people’s children around.
However, it’s important to consider the possibility the driver did nothing wrong. It could be that a tire blew out. There may have been a sudden medical emergency. Maybe the owner of the bus hasn’t been maintaining it properly, leading to a mechanical failure. Issues with the roadway can lead to crashes like this.
At the end of the day, the evidence needs to speak for itself. It’s one thing to get answers about the cause of a crash. On top of that though, with something as delicate as the safety of children, the parents of these kids and others who may use this daycare need to be sure this sort of thing won’t happen again in the future. That requires looking into any possible issues that may have taken place long before the driver got behind the wheel.
