Commentary by Attorney Michael Grossman

When a box truck collides with the side of a pickup, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, side-impact crashes like this often involve multiple contributing factors that need to be examined.

Which vehicle had the right-of-way? Determining fault in a side-impact crash often comes down to whether one driver failed to yield. Did the box truck run a stop sign or traffic light? Did the pickup enter the intersection when it wasn’t safe to do so? Investigators should review traffic control devices, witness statements, and any available surveillance footage to clarify the sequence of events.

Was either driver distracted or impaired? A moment of inattention—whether from a phone, GPS, or another distraction—can cause a driver to miss an oncoming vehicle. Investigators should examine phone records, dashcam footage, and potential toxicology reports to determine whether distraction or impairment played a role.

Did speed contribute to the severity of the crash? Higher speeds make it harder to avoid a collision and increase the likelihood of serious injuries. Investigators should analyze skid marks, vehicle positioning, and electronic data to determine whether either vehicle was traveling too fast for the conditions.

Did broader issues contribute to the wreck? Box trucks, like all commercial vehicles, require proper driver training and maintenance. If the truck’s brakes or steering system failed, or if the driver lacked proper training in defensive driving, that could be relevant in understanding why the crash happened. Investigators should review maintenance records, driver history, and company policies to determine whether broader issues played a role.

At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity and closure they deserve.
