Commentary by Attorney Michael Grossman

This crash raises significant questions about why the driver of a box truck lost control and went off the road. The severity of the crash underscores the importance of understanding the circumstances that led to the incident.

The primary focus of the investigation will likely be on what caused the driver to lose control. Was the driver speeding, distracted or impaired? Evidence such as skid marks, witness statements and any onboard telematics or dashcam footage will be critical in determining whether driver behavior contributed to the crash.

The condition of the box truck is another key factor. Was the vehicle properly maintained, and did its braking, steering or other critical systems function as they should have? A mechanical failure could potentially explain the driver’s inability to maintain control, and a thorough inspection of the truck will help rule out such issues.

The road conditions on Powder Mountain Road also warrant scrutiny. This area is known for steep grades and sharp curves, which can be particularly challenging for large vehicles like box trucks. Investigators will need to assess whether the road was properly maintained and whether there were any hazards, such as ice or debris, that might have contributed to the crash.

The ejection of both the driver and passenger raises concerns about seatbelt use. Seatbelts are critical in preventing occupants from being thrown from a vehicle during a crash, significantly reducing the likelihood of serious injuries. Determining whether seatbelts were in use and functioning properly at the time of the crash is an important part of the investigation.

For the injured occupants, finding answers about what caused this crash is essential. A thorough investigation will help clarify whether driver actions, vehicle issues or road conditions were at fault.
