Commentary by Attorney Michael Grossman
This crash highlights the inherent risks of operating large commercial vehicles on rural, two-lane highways. These roads often lack safety features like barriers or wide shoulders, leaving little room for error.
The ongoing investigation will be crucial in determining whether driver error, mechanical issues or environmental factors caused this crash. All of these factors could be in play in this collision, based on my experience.
On a two-lane highway, one truck may have crossed the centerline or attempted an unsafe maneuver, such as overtaking another vehicle. Investigators should evaluate whether either driver crossed into oncoming traffic and whether road markings or signage were clear and adequate to prevent confusion.
Was one of the drivers distracted, fatigued or impaired? Fatigue is a frequent issue for truck drivers, particularly in the early morning hours when circadian rhythms naturally promote drowsiness. Cell phone records and toxicology reports should help investigators rule out distraction or impairment.
Were both drivers adequately trained for nighttime driving on narrow highways? Investigators should review their safety records, compliance with hours-of-service regulations and recent driving logs to determine if either driver was operating under pressure to meet tight deadlines.
Investigators should examine both trucks for potential mechanical issues, such as brake failure, steering malfunctions or blown tires. Cargo weight and distribution could have affected the handling of either vehicle, particularly during evasive maneuvers. Overloaded or improperly balanced cargo can increase the likelihood of a loss of control.
Evidence such as tire marks, vehicle damage, and witness statements will be crucial for reconstructing the crash. If either truck was equipped with a dashcam, the footage could provide critical insights into the moments leading up to the collision.
There are a lot of elements to investigating commercial vehicle accidents. If authorities don’t have the time or expertise to satisfactorily answer the questions I’ve raised about this crash, perhaps the victim’s family would be better served with an independent investigation.
