Commentary by Attorney Michael Grossman
One of the challenges with investigations into motorcycle accidents is that they’re less reliable than usual. This is because a lot of people are automatically inclined to just blame motorcyclists without actually knowing all of the facts. Even officers may let bias color their investigations, and they’ll jump to a conclusion based on gut instinct rather than clear evidence. This, of course, is another reason independent accident reconstructionists tend to be more reliable after a serious accident. Since their job is to consider even unlikely possible factors, they can ensure that the evidence speaks for itself without letting unfair bias gets in the way. It wouldn’t be surprising if that proved true here, as well.
