How Did This Accident Occur?

Most people who read about a crash like this — one vehicle late at night on a rural stretch of road — likely would assume it happened because the driver was distracted or fatigued. That may be the case, but I’ve learned over more than 30 years of being involved in accident investigations is that assumptions are no replacement for facts.

Facts will prove what happened on F.M. 1322, after investigators scrutinize evidence from the scene, data from the Cadillac’s engine control module and any available witness statements or video of the crash. Cell phone records could show if the driver was distracted at the time of the accident, but an independent expert may be needed if investigators suspect a mechanical issue contributed to the crash.

Most law enforcement agencies do not have the time or training to conduct a forensic examination of the SUV, in my experience, but that is the best way to determine if it had a problem with its brakes or steering mechanism.

Crash investigations should be about doing whatever is necessary to reconstruct an accident. The injured driver and her family deserve to know what happened.
