Commentary by Attorney Michael Grossman
One of the most common concerns I hear from families affected by single-vehicle wrecks is they worry their loved one’s side of the story won’t be told fairly since the victim isn’t around to defend themselves. That’s reasonable concern. Unfortunately, that concern is even more relevant with motorcyclists.
The reality is a lot of people are negatively biased against motorcycle riders. Even authorities are sometimes quick to let their biases take over, and that can result in shallow, rushed, and incomplete investigations.
That’s one of the many reasons independent accident reconstructionists often prove to be the more prudent approach to deadly accidents. Their priority is simple: get the facts. If a family can be certain that the evidence is able to speak for itself, it can be a world of weight off of their shoulders, regardless of what led to an accident. I have to wonder if authorities are handling this accident with equal care.
