Commentary by Attorney Michael Grossman

When people hear about crashes like this one, it’s easy to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks tend to be more complicated, and it’s essential to thoroughly investigate all factors contributing to these incidents.

First, we need to determine what caused the truck to collide with the parked patrol car. Was the truck driver distracted, fatigued, or dealing with poor visibility in the early morning hours? Reviewing data from vehicle event recorders, traffic camera footage, and witness statements can provide crucial insights into these questions.

Next, the role of the trucking company must be scrutinized. Was the driver properly trained and following company safety protocols? Trucking companies have a duty to ensure their drivers are well-prepared for the challenges of the road, especially in situations involving work zones and emergency vehicles. If the company neglected proper training or allowed unsafe driving practices, they might share responsibility for the incident.

Additionally, it’s important to examine the condition of the truck. Was the vehicle properly maintained? Mechanical failures, such as brake malfunctions or steering issues, can significantly contribute to accidents. Reviewing maintenance records and conducting thorough inspections of the vehicle can reveal if such problems were a factor.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation in order to obtain vital evidence, it is crucial to consider every factor in order to ensure that those impacted by the crash receive the clarity and closure they deserve.
